    MILLVILLE -- The only car club in the New Jersey Motorsports Park's inaugural season left off the 2009 schedule is being sued over unpaid bills.

    The Motorsports Park, which opened last July, is suing Shelby American Automobile Club for more than $115,000 for track rentals and other fees associated with the club's August race weekend.

    The club, however, says the issue has been resolved and a 2009 date is in the works.
    The track's ownership groups, New Jersey Motorsports LLC, NJMP Management LLC and NJMP Operating Company LLC, filed suit Nov. 25 in Cumberland County Superior Court, charging the club owes the Motorsports Park $115,780.50 plus costs and legal fees for outstanding charges from the weekend.

    Kenneth Eber, national director for the club, said Monday he reached a verbal agreement with Motorsports Park co-owner Harvey Siegel last week.
    He said the club has set a tentative date next summer at the Motorsports Park, and it has agreed to allow the club to use proceeds from the 2009 event to settle any outstanding debts from August.

    "We have a verbal agreement with New Jersey Motorsports Park to resolve the issue," Eber said, adding he hasn't yet seen the lawsuit.
    Motorsports Park co-owner Joe Savaro said the track is in negotiations with the SCCA for a 2009 date, but would not comment further or discuss the suit.
    "We like their operation, and we would like to have an event" in 2009, he said.

    The Motorsports Park's attorney Kyle Culzer declined to comment on the lawsuit.
    Club officials said during the August race that it wanted to make the track its home for their convention for at least the next three years. Eber said the club is committed "more so than ever" to the facility.

    "We want to grow it each year and make it a major event on the East Coast," he said of their convention. "We're looking forward to next year as are they."

    SAAC was the only 2008 car club not on the 2009 schedule announced Dec. 8, but Motorsports Park officials did not rule out the club could be added to the list of spectator events.

    According to the lawsuit, the two sides finalized the contract on April 22 and SAAC made a deposit payment of $9,375 for the track rental on April 10 and a $14,200 deposit for VIP suites and garages rental on May 23.

    The club was supposed to pay the rest of the money 30 days before the event, but Eber asked the Motorsports Park if he could make the payment at the end of the three-day event, because it had not received all the money from the participants, according to the suit.

    They agreed, but when Motorsports Park Director of Activities Joe Volpe tried to approach Eber on the last day of the event, an SAAC official told him Eber left the track and would not return, according to the suit.
    The club had not made any other payments when the suit was filed on Nov. 25, the document stated.
    Eber said Monday that issue was a "communication problem."

    In a letter to Motorsports Park co-owner Lee Brahin on Oct. 16, Eber acknowledged the charges, but said the club should be credited for ticket sales and fees the Motorsports Park mistakenly collected.

    The letter, and copies of rental agreements and bills, were included in the lawsuit.
    A response from Eber, also included in the suit, indicated the club hit financial troubles following a lawsuit over the use of the Shelby name.The case was settled, but cost the club money in legal fees, which is partly why they haven't paid the Motorsports Park, Eber said.

    19 VIP Garage Rentals ($750 each): $14,250

    Track rental of Thunderbolt Raceway for Friday, Aug. 15: $10,500

    Track rental of Thunderbolt Raceway for Saturday and Sunday, Aug. 16 and Aug. 17: ($13,500 each) $27,000

    Ambulance: $1,050

    41 Flaggers ($135 each): $5,535

    60 golf cars ($275 each): $16,500

    A catered buffet dinner and 5 cash bars on Aug. 16: $19,600

    Garage rentals: $3,990

    Sales tax for the garages, suites and golf cars: $5,895

    The SAAC made two payments totaling $23,575.

    The Motorsports Park added a 10 percent surcharge and is asking for $115,780.50 plus costs and legal fees in the lawsuit

    BeaveRun is in bankruptcy - but the better of the two ( chapter 7 or 11 ).

    They're still scheduling events from what I hear.

    Anyway - if at all possible, plan on making it to the SAAC show - you'll never see so many beautiful Shelbys in one place. And watching a bunch of them get thrashed on the track is pretty fun too...
