Just thought I'd update everyone on this. He went to court over this last week and the ruling was for the driver to pay him $7000 ($300/month plus his tax returns). He's still getting screwed financially but he's going to try and part out the bike or sell it to make back some of his money. I'll try and snap a couple pics of it in the garage tonight. We managed to get the tail piece back down flat (it was pointing straight up from the wreck), removed the power commander, speedo healer, and a couple other items. Overall, a shitty deal for him but it could have been worse.

Was the $7K comp for pain and suffering or for the damage to his bike?

I'm not sure, but $7k is all he's getting. He even had a personal injury lawyer (who, in my opinion, didn't do a very good job).

Did he have "limited tort" insurance?

Yes it sounds like his attorney was a hack! Unfortunately most attornys today are hacks! Their practice is based on taking as many cases as they can, settle them quickly, in most cases under valued and not in the best interest of their clients just to make a quick buck and move on to the next case.

Man, that's just the way our country is going.

Moron who can't figure out that hot coffee is ... HOT, spills it on her lap in McDonald's - Gets about a million bucks (what was that, the mid 90's?)

Your friend is riding responsibly, gets run over by a negligent/incompetent/should-be-considered-criminal driver that tries to flee the scene in one of the most destructive and deadly ways possible and literally almost killing your friend... 7 grand.

Honestly, I'm really mad at your friend's attorney right now, as well as out "justice" system. Really mad. The attorney did not do his job to the fullest extent, in a situation that very much deserved it.

He had liability only insurance on the bike. He told me full coverage for the bike was some outrageous premium which is why he didn't have it. In any scenario where the driver was a responsible member of society, this would not have been a problem since my roommate wasn't at fault. The problem in this case was that the driver was a dead beat with NO INSURANCE

Yea, he was pretty pissed about how little his attorney seemed to be doing up till the court date, and he was honestly surprised he even got any money at all. He tried calling Edgar Snyder, but they turned him down because, in my opinion, his claim wasn't profitable enough for them. They recommended the lawyer he ended up with, who knows why.

Doesn't surprise me he didn't have insurance! ... what a total scum-bag! Good luck get any money out of him!

I guess he didn't have un-insured or under-insured coverage ... I'm not even sure this is available for comp only coverage???

Well regardless your roommate "got the old KY"!

I seriously hope that asshole lost his license. Don't tell me he got off other than paying your friend the $7000. I'd be pissed as hell if I was your roommate.

If it's the same intersection I'm thinking of (48 and 22 by Valley Honda), I was just sitting there tonight in the turning lane and every single car that was turning on 22 from 48 cut the corner way too sharp and was totally in my lane and only missed my Cobra by like 2 feet. People suck as driving, every time I go out I get so pissed at people that can't stay in their lane.

Another update, my roommate was supposed to get a check for $300 BY the 15th, and he still hasn't gotten any money. The worst thing is, there really isn't anything to make the dead beat pay. If he doesn't pay, all he gets is a fine and eventually a suspended license, no risk of even jail time. I swear the legal system in this country is completely worthless.

If anyone has some suggestions as to what he should do about this, feel free to chime in.

Piss on his lawyer, get a better one. I was hit 4 1/2 years ago. Actually just this morning, had my arbritration hearing. My accident was alot less damage and suffering then your friend and i'm getting alot more then 7k. It took damn near 5 years but it's finally closed thank god. If your buddy needs a great lawyer, PM me.

I haven't followed this thread till now, but make sure he keeps receipts for everything, copies of every hospital bill, records of time off work, etc etc... Make sure his bike estimate includes the helmet and all his gear.

He can't afford to get another lawyer, he's getting medical bills coming in right now and is just getting by as it is. He originally called Edgar Snyder, they didn't want to take his case because there wasn't enough money involved, so they recommended the hack lawyer that he has now. Every time I see those Edgar Snyder commercials about how they care about motorcyclists, I want to punch Edgar in the face
