The Sitz Court relied on well-settled law that motorists have a lessened expectation of privacy regarding stops and visual searches of automobiles on the nation's roadways. Id. at 450 (explaining the importance of the context of 'police stops of motorists on public highways'). At these sobriety checkpoints, which motorists may choose to avoid, only the initial brief stop and preliminary questioning may take place without individualized suspicion: 'more extensive field sobriety testing' requires justification. Id. at 450-2.

    Sure is.... I CC and have OC'd before without problem but I still think there are some on PAFOA that go out looking to "School" LEO or looking for a story to come back and post.

    That is my opinion also. Ive been through 4 check points in the last few years with no complaints till now. If these stops save one life its worth it to me to stop. just not surewhat went wrong this last time.

    Some people have know problem giving up their libertys for safety, glad I'm not one of them.

    He wasn't stopped for 2 whole minutes, that's the problem. If LE new he wasn't drinking, then he should have been allowed to procede. Since when does a DUI checkpoint turn into a weapons checkpoint.

    The biggest issue I have with this hole thing is that Lou was not drinking, and did not give the officers a hard time. He should have been allowed to proceed with no further questions.

    Well then if that's the case as you say then it's pretty bad when a civilian has to "school LEO" about a law that they should already know. After all their job is "law enforcement".

    If they don't know what the law is then maybe they need to go back to the academy and learn.

    I have another carrying question..Is it legal to carry in bars? I have had different people tell me different things. I know its usually not a good idea to carry if you are drinking, Im just curious about the laws on carrying in a bar.

    Lets say you are arrested for DUI and I have to tow your car. I can legally do an inventory search of its contents.

    Imagine that. No search warrrant or anything.

    I beleive you can OC in Philly but must have a LTCF due to it being classified a 1st class city(1 million or more people).

    Philly is the only 1st class city in Pa so a LTCF is needed. You can OC in any other city in Pa without a LTCF if you are on foot, including Pgh.

    Well that would give you RAS to do so. What I'm saying if you have no RAS, meaning if I get stopped at a DUI checkpoint and I'm not drinking, you have absolutely no right to search my vehicle without my consent or a warrant. This would also apply to a routine traffic stop, correct?

    So yes the 4th amed does apply to vehicles as well.
